TERMS & CONDITIONS – Aamantran
- Introduction
Welcome to Aamantran (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our marketing, communication, and advertising solutions, including but not limited to our WhatsApp Business API, RCS messaging tools, web portals, dashboards, and any related products or services offered under the Aamantran brand (collectively referred to as the “Services”).
By accessing or using our Services, you (“User,” “you,” or “your”) agree to be bound by these Terms. Please read them carefully before using our website or services. If you do not agree to these Terms, you must not use our Services.
- Definitions
“Account” refers to the registered user profile created for accessing Aamantran’s services.
“Client” means a business or individual availing of Aamantran’s advertising and marketing services.
“Content” means any text, graphics, messages, media, or other materials transmitted through Aamantran’s platforms.
“WhatsApp API” means the official WhatsApp Business API provided by Meta Platforms, Inc. and integrated by Aamantran for client use.
“RCS” means Rich Communication Services provided via telecom operators and Google’s RCS framework.
“Personal Data” has the same meaning as under the Information Technology Act, 2000 and related data protection rules in India.
- Acceptance of Terms
By registering for or using Aamantran’s Services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept all obligations described herein.
Your continued use of the Services constitutes ongoing acceptance of these Terms and any subsequent modifications.
- Description of Services
Aamantran provides professional advertising and marketing solutions enabling businesses to manage and send automated communications via WhatsApp, RCS, and other digital platforms. Our Services include:
Campaign management and automation tools;
Bulk and transactional messaging via WhatsApp and RCS;
Audience analytics and engagement reporting;
API integrations for businesses; and
Customer engagement and promotional communications.
We act as a technology enabler and message delivery partner. Aamantran does not initiate unsolicited communication on behalf of clients without explicit consent or legal authorization.
- Eligibility
To use Aamantran’s Services, you must:
Be a business entity or individual operating lawfully in India;
Hold all necessary licenses or authorizations for marketing communications;
Provide accurate, current, and complete registration details; and
Use the Services strictly in compliance with applicable laws, Meta’s Business Messaging Policies, and telecom operator guidelines.
- Account Registration
Users are required to register an account using accurate business details, including valid email and contact information.
You are responsible for maintaining the confidentiality of your account credentials and are solely liable for all activities conducted through your account.
Aamantran reserves the right to suspend or terminate accounts found to be in violation of these Terms or applicable law.
- User Responsibilities
You agree not to
Use the Services for unlawful, abusive, or fraudulent purposes;
Send unsolicited promotional or spam messages;
Violate Meta’s or telecom operators’ messaging policies;
Interfere with service performance, security, or other users’ experiences;
Transmit harmful code, viruses, or automated bots;
Misrepresent your identity or affiliation.
You are responsible for ensuring that your message content complies with applicable laws including the Consumer Protection Act, 2019, Information Technology Act, 2000, and Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018.
- Payment & Billing Terms
Aamantran’s services may be billed as prepaid or postpaid subscriptions.
All payments are to be made in Indian Rupees (INR) via approved payment gateways or bank transfers.
You agree to pay all applicable charges, taxes, and fees as per the plan selected.
Non-payment may result in suspension or termination of Services.
Invoices are typically issued electronically and deemed accepted unless disputed within 7 business days.
- Subscription Renewal & Termination
Subscriptions renew automatically unless cancelled prior to the renewal date.
You may terminate your subscription at any time by notifying us at sakshi@aamantran.shop
Upon termination, access to Services will cease immediately; however, obligations accrued before termination will survive.
Aamantran reserves the right to terminate any account that breaches these Terms or applicable laws.
- Use of WhatsApp Official API & RCS
Aamantran integrates official APIs provided by Meta (WhatsApp Business API) and Google/Telecom Operators (RCS) for business messaging.
You acknowledge that:
All messages must comply with the policies of the respective platforms.
Aamantran serves as a technical intermediary, not as a controller of message content.
WhatsApp and RCS reserve the right to suspend or restrict messaging privileges for violations.
Message delivery depends on third-party networks, and Aamantran does not guarantee 100% delivery.
- Message Delivery & Compliance Policy
Message delivery may vary due to network conditions, device status, or platform restrictions.
Aamantran employs best practices for reliable delivery and lawful content transmission.
Users must ensure:
Messages are opt-in and non-spam;
Templates comply with Meta and telecom guidelines;
Customer data used for messaging is obtained with consent.
Violation of messaging standards may result in account suspension without refund.
- Intellectual Property Rights
All software, designs, trademarks, and content associated with Aamantran remain our exclusive intellectual property.
Clients retain ownership of their own marketing materials and message content but grant Aamantran a limited license to use them solely for service provision.
Unauthorized reproduction or redistribution of Aamantran’s platform or brand assets is strictly prohibited.
- Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared in the course of business.
Confidential information shall not be disclosed to third parties except as required by law or necessary for service performance.
- Disclaimer of Warranties
Aamantran provides its services on an “as-is” and “as-available” basis.
We make no warranties, express or implied, regarding uninterrupted service, error-free performance, or guaranteed delivery outcomes.
All external integrations (Meta, Google, telecom operators) are subject to their own availability and terms.
- Limitation of Liability
To the fullest extent permitted by law, Aamantran shall not be liable for indirect, incidental, or consequential damages, including loss of data, business interruption, or revenue loss, arising out of your use or inability to use our services.
Our total liability, if any, shall not exceed the total amount paid by you in the three months preceding the claim.
- Indemnification
You agree to indemnify, defend, and hold harmless Aamantran, its owner, employees, and partners against any losses, liabilities, or claims arising from:
Violation of these Terms;
Misuse of our Services;
Infringement of intellectual property or data privacy rights; or
Transmission of unlawful or unsolicited communications.
- Governing Law
These Terms are governed by and construed in accordance with the laws of India, with jurisdiction exclusively vested in the courts of Aurangabad, Maharashtra.
- Changes to Terms
Aamantran reserves the right to amend these Terms at any time. Updates will be posted on our official website. Continued use of our Services after such modifications constitutes acceptance of the revised Terms.
